摘要：数字政府建设背景下，人脸识别技术在公共行政领域的广泛应用，在为行政机关高效履行职权、提升治理效能技术赋能的同时，也因人脸信息的强依附性与不可更改性，给公民基本权益带来严峻考验。公共行政机关处理人脸信息的行为，涉及公民个人信息权、隐私权等核心人格权益。尽管我国已初步确立以《个人信息保护法》《数据安全法》为核心的法律框架，但在应对公共行政场景的特殊性时，仍面临立法针对性不强、全流程监管缺位及权利救济实效不足等制度困境。本文立足我国现行立法现状与突出问题，借鉴域外国家的有益经验，提出完善我国公共行政中人脸信息处理的规制路径，旨在厘清行政权力的数字化边界，实现行政效能与公民权益保障的动态平衡。

Title: Legislative Challenges and Improvement Pathways for Facial Information Processing in Public Administration
Abstract: Against the backdrop of digital government development, the widespread application of facial recognition technology in public administration has empowered administrative bodies to exercise their functions efficiently and enhance governance effectiveness. However, the inherent dependency and irreversibility of facial information pose severe challenges to citizens’ fundamental rights. The processing of facial information by public administrative bodies involves core personal rights such as citizens’ personal information rights and privacy rights. Although China has established a preliminary legal framework centred on the Personal Information Protection Law and the Data Security Law, institutional challenges persist when addressing the specificities of public administrative scenarios. These include insufficiently targeted legislation, gaps in end-to-end oversight, and inadequate effectiveness of rights remedies. This paper, grounded in China’s current legislative landscape and prominent issues, draws upon the beneficial experiences of the EU’s risk-based tiered governance and the US’s scenario-based regulation. It proposes pathways to refine legislative regulation governing facial information processing within public administration, aiming to clarify the digital boundaries of administrative power and achieve a dynamic equilibrium between administrative efficiency and the protection of citizens’ rights.
